By accessing or using services provided by Ensign Hospitality, LLC (“Company,” “we,” “our,” or “us”), including hotel accommodations, Airbnb rentals, boat rentals, and float trips, you agree to these Terms of Service (“Terms”). If you do not agree, do not use our services.

2. Company Overview

Ensign Hospitality, LLC operates hotel properties under franchise agreements with brands such as Marriott, Hyatt, and Hilton, provides overnight rentals through Airbnb, and offers leisure services including boat rentals and float trips in national park regions across Utah, Idaho, and Arizona.

3. Hotel Guests and Airbnb Rentals

Hotel stays are governed by the respective brand’s terms and conditions (e.g., Marriott, Hyatt, Hilton).
Airbnb stays are subject to Airbnb’s platform terms in addition to these Terms.
By booking or staying at any property, you agree to comply with applicable brand or platform terms.

4. Eligibility

Services are intended for individuals 18 years or older.
Minors must be accompanied by a parent or legal guardian at all times during hotel stays, Airbnb rentals, and leisure activities.
By using our services, you represent that you have the legal capacity to enter into these Terms.

5. Reservations and Payments

Reservations for hotels, Airbnb rentals, and leisure activities require valid payment information.
Rates, taxes, and fees are disclosed at booking.
Cancellation and refund policies vary by property and activity; please review at the time of booking.

6. Boat Rentals and Float Trips

All participants must comply with safety instructions provided by staff.
Life jackets and safety gear are mandatory.
Alcohol consumption during float trips or boat rentals is prohibited unless expressly permitted by law and company policy.
We reserve the right to refuse service to anyone who appears intoxicated or poses a safety risk.

7. Support Services

We provide customer support via SMS and email.
By contacting us, you consent to receive responses through these channels.
Standard messaging and data rates may apply.

8. Prohibited Conduct

You agree not to:

Engage in unlawful, unsafe, or disruptive behavior.
Damage property or equipment.
Violate any applicable laws, park regulations, or franchise brand standards.

9. Liability Disclaimer

Services are provided “as is” and “as available.” To the maximum extent permitted by law:

We disclaim all warranties, express or implied.
Our liability is limited to the amount you paid for the specific service in the 12 months preceding the claim.
We are not liable for indirect, incidental, or consequential damages.

10. Assumption of Risk

Participation in leisure activities such as boat rentals and float trips involves inherent risks, including injury or death. By participating, you acknowledge and assume these risks voluntarily.

11. Indemnification

You agree to indemnify and hold harmless Ensign Hospitality, LLC, its affiliates, and franchise partners from any claims, damages, or expenses arising from your use of our services.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Utah, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in Utah.
